Terms of Service

These Terms of Service ("Terms") govern your use of xptracker ("we," "us," or "our") and the software-as-a-service platform ("Service") provided on https://xptracker.app (the "Site"). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By using the Service, you accept and agree to be bound by these Terms and all applicable laws and regulations. You represent and warrant that you are at least 18 years of age and are legally able to enter into a contract.
2. Account Registration
To access certain features of the Service, you may be required to create an account. You can register using an email address and password, or by authenticating through a supported third-party provider (such as Bluesky via OAuth). You agree to provide accurate, current, and complete information during the registration process and to update it as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect any unauthorized access or use of your account.
3. Use of the Service
You agree to use the Service in accordance with all applicable laws and regulations and not to engage in any unlawful, harmful, or fraudulent activities. Prohibited activities include but are not limited to:
- Violating any laws or regulations
- Attempting to gain unauthorized access to the Service or any related systems
- Disrupting or impairing the Service’s functionality
- Using the Service for spamming or distributing malicious software
- Publishing illegal, defamatory, or harmful content via public features (journal entries, resume pages, or third-party sharing)
- Abusing third-party integrations (such as Bluesky) in a way that violates their terms of service
- Uploading malicious files, files containing illegal content, or files that exceed posted size limits
- Misusing AI-powered features (such as resume parsing or label generation) to process content that is not legitimate career data
4. User Content
You retain ownership of all content you create within the Service, including experiences, skills, projects, achievements, journal entries, uploaded files, and profile information ("User Content"). By making User Content publicly available through the Service’s opt-in features (such as public journal entries, public journal feeds, or shareable resume pages), you grant us a non-exclusive, worldwide, royalty-free license to display and distribute that content as part of the Service for as long as it remains public.
You may revoke this license at any time by toggling your content back to private, at which point it will no longer be publicly accessible through the Service. You are solely responsible for the content you choose to make public.
File Uploads
The Service allows you to upload files including images (up to 3MB each, maximum 3 per journal entry) and resume documents (up to 5MB) for AI-assisted parsing. Uploaded files are stored securely in cloud storage and are deleted when the associated record is deleted. You are responsible for ensuring you have the right to upload any files you submit.
5. Third-Party Services
The Service uses and offers optional integrations with third-party services. By using the Service, you acknowledge:
- Bluesky (AT Protocol) — You may optionally link your Bluesky account, share journal entries to Bluesky, or publish content via the AT Protocol. You authorize us to interact with Bluesky on your behalf, limited to the actions you explicitly initiate.
- AI-Powered Features — The Service uses Anthropic’s Claude API to provide AI-assisted resume parsing, label generation, and label linking. When you use these features, relevant career data is processed by Anthropic’s systems. Results are subject to the limitations of AI and may require your review and correction.
- Email Delivery — We use Postmark to deliver transactional emails (verification, password resets).
- Cloud Storage — Uploaded files are stored using DigitalOcean Spaces.
- Error Monitoring — We use Sentry to track and resolve application errors.
Content shared to third-party platforms is governed by that platform’s own terms of service and privacy policy once published. We are not responsible for the availability, accuracy, or policies of any third-party service. You may disconnect optional integrations (such as Bluesky) at any time from your account settings.
6. Licenses and Restrictions
We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes. You may not:
- Copy, modify, or reverse-engineer the Service
- Transfer, lease, sublicense, or sell the Service without express written permission
- Use the Service to compete with our business
7. Payment and Billing
Certain features of the Service may be subject to a subscription fee or other charges. You agree to pay all applicable fees for your use of the Service in accordance with the billing terms set forth on the Site.
We reserve the right to modify pricing and billing terms at any time, with notice provided to you. Payments are non-refundable unless otherwise stated.
8. Data Privacy
Your use of the Service is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your data as described in our Privacy Policy.
9. Intellectual Property
All intellectual property rights in the Service, including software, content, design, and trademarks, are owned by us or our licensors. You may not use any of our intellectual property without our prior written consent.
10. Termination
We reserve the right to suspend or terminate your access to the Service at our discretion, including for violations of these Terms. You may terminate your account at any time by submitting a support ticket here.
Upon termination, your account and all personally associated data will be deleted, including your profile, career data, uploaded files, and linked third-party account information. Content previously shared to external platforms (such as Bluesky) will remain on those platforms and must be deleted separately.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the Service. Our total liability will be limited to the amount paid by you for the Service during the three months prior to the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, expenses, or damages, including reasonable attorney’s fees, arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
13. AI-Powered Features Disclaimer
Certain features of the Service use artificial intelligence to assist you, including resume parsing, label generation, and automatic label linking. AI-generated results are provided as suggestions only and may contain errors or inaccuracies. You are responsible for reviewing, editing, and confirming any AI-generated content before it is applied to your account. When using bulk operations (such as bulk label linking), labels are applied automatically based on AI suggestions. We do not guarantee the accuracy, completeness, or suitability of AI-generated output.
14. Analytics
We collect anonymized analytics on public pages to understand how the Service is used. This data does not identify individual users and is used solely to improve the Service. See our Privacy Policy for details on what is collected.
15. Modifications
We may update or modify these Terms from time to time. Any changes will be posted on this page, and the "Last Updated" date will be revised. Your continued use of the Service after the posting of any changes constitutes your acceptance of the new Terms.
